Intrastate authority in Tennessee
- Who needs it. For-hire carriers and private towing and wrecker services operating inside Tennessee need Intrastate Authority from the Department of Revenue, filed online through TNTAP. It costs $50 per application plus $8 per vehicle.[1] A vehicle already filed under UCR doesn’t need it.[2]
- Filings. A Form E (liability) is required, and a Form H (cargo) for carriers of general freight, household goods and mobile homes.[3]
- One office for everything. The Revenue Department’s Motor Carrier Section handles Intrastate Authority, IRP, IFTA and UCR online (615-399-4265). There’s no walk-in office.[2]
Tennessee insurance limits
| Carrier | Minimum |
|---|---|
| For-hire, 10,001 lb GVWR or more, non-hazmat | $750,000 |
| Under 10,001 lb | $300,000 |
| Hazmat | $1,000,000 or $5,000,000 |
| Cargo, common carriers | $5,000 per vehicle, $10,000 per occurrence |
These come from the Revenue Department’s motor carrier rule, updated March 9, 2026, which also requires 30 days’ written notice before a policy is cancelled.[4]
USDOT numbers, safety rules and drivers
- No state USDOT rule. Tennessee isn’t on FMCSA’s list of states that require USDOT numbers for intrastate carriers.[5] Intrastate trucks must instead show the declared gross weight and the carrier’s name and address.[4]
- Safety rules follow the federal rules, except the age-21 rule for intrastate carriers.[4] They don’t apply to intrastate property trucks of 26,000 lb or less, unless they haul placarded hazmat, and farm vehicles that stay in Tennessee are exempt.[6]
- Drivers. CDL applicants may be 18, but drivers under 21 can drive only inside Tennessee. Tennessee does not issue non-domiciled CDLs.[7]
2026 laws that affect carriers
- Employer liability for unlawfully present drivers. From July 1, 2026, an employer that knowingly lets a person who is unlawfully present in the U.S. drive a commercial vehicle is strictly, jointly and severally liable for resulting injuries and damage. Brokers and shippers are excluded, and the law says a liability policy isn’t to be read as covering these claims unless it expressly does.[8] Check every driver’s eligibility before hiring.
- Freight fraud. A new crime of fraudulent freight theft, including double brokering, took effect July 1, 2026.[9]
- Damages cap. Noneconomic damages remain capped at $750,000, or $1,000,000 for catastrophic injuries.[10]
Weights, permits and lanes
- Limits are strict. 80,000 lb gross, 20,000 lb single axle and 34,000 lb tandem, with no tolerance except by permit.[11]
- 10% margin for some loads. Logs, sand, coal, clay, shale, phosphate, solid waste, recovered materials and farm trucks get a 10% margin on state highways other than Interstates. Idle-reduction equipment adds up to 550 lb, and natural gas or electric trucks can run up to 82,000 lb on Interstates.[11]
- Permits. Overweight single-trip permits are $20 plus 6 cents per ton-mile, and annual overweight permits are $750 up to 100,000 lb. The permit office is 615-741-3821.[12]
- Right two lanes. Tractor-trailers must stay in the right two lanes on posted Interstates with 3 or more lanes each way.[13] The speed limit is 70 mph on 4-lane controlled-access highways for trucks and cars alike.[14]
- Knoxville hazmat. Placarded hazmat is banned on I-40 and I-275 inside the I-640 loop, except for local deliveries.[4]
Fuel tax and tolls
Diesel is taxed at 27 cents a gallon, plus a 1-cent special tax and a 0.4-cent environmental fee.[15] FHWA lists no toll roads in Tennessee.[16] The state picked a partner in August 2026 for the I-24 Southeast Choice Lanes, optional paid lanes of about 26 miles that are not built yet.[17]
Tennessee freight
Trucks carry 71.3% of Tennessee’s freight tonnage. The busiest truck segment is I-240 in Memphis, at 16,519 trucks a day, and the Port of Memphis handled 8.6 million tons in 2020.[18] The state’s worst truck bottleneck is I-24 eastbound in Nashville between Spring Street and the I-65 interchange.[19] Memphis International Airport handled 6.54 billion pounds of cargo in 2025.[20] Tennessee’s auto industry has more than 144,700 jobs, 900 companies and 4 automakers.[21]
